Terms of Use and General Terms and Conditions

Version: 10 September 2026 · Applies to all smartIDEA apps: FamilyCup, RunCoach, Freiraum Kids, Freiraum Life & Family and LumaLink. For Freiraum Genius these terms apply from its release. This is a convenience translation; the German version is the binding one.

1. Provider, scope, relationship with Apple

The provider of the apps and your contracting party is:

"smartIDEA" is the project name of this private developer project. Below, "I", "me" or "the provider".

These terms govern the use of the apps FamilyCup, RunCoach, Freiraum Kids, Freiraum Life & Family and LumaLink, including their Apple Watch apps, widgets, Live Activities, web pages (such as the FamilyCup group page) and server services (together "the apps"). The app-specific terms in section 18 apply in addition and prevail in case of conflict.

The apps are distributed through the Apple App Store. Apple is not a party to these terms and is not responsible for the apps, their content, maintenance or support. The Apple Media Services Terms and Conditions apply to purchase and payment through the App Store. Where these terms offer less protection than Apple's Standard Licensed Application End User License Agreement, the more protective provision applies.

2. Conclusion of contract and requirements

By downloading and using an app you enter into a free-of-charge usage agreement with me under these terms. Paid services (one-time purchases, credits, subscriptions) are acquired through the App Store's in-app purchase function; the purchase contract is concluded when you tap the purchase button and Apple confirms.

You need a compatible Apple device with the stated minimum system, an Apple Account and, depending on the feature, iCloud (Apple CloudKit) and an internet connection. You bear the cost of data connections.

Users must be of legal age or act with the consent of a parent or guardian; children in Freiraum Kids are covered by section 10.

3. Licence

You receive a non-exclusive, non-transferable, non-sublicensable, revocable right to use the app on devices you own or control and that are linked to your Apple Account, solely for private, non-commercial purposes.

You may not copy, modify, decompile, reverse-engineer the app or create derivative works (except where mandatory law permits); circumvent protection mechanisms or quotas; rent, lend or make the app available to third parties; query server services in an automated or unusual manner; or use the apps for unlawful purposes.

Updates may add, change or remove features. These terms also apply to updates unless new terms are communicated.

4. Free features, purchases, subscriptions and trials

The apps are free to download or available as a one-time purchase; individual features are paid. The applicable price is shown before purchase in the App Store or in the app and includes VAT. Payment, invoicing and processing are handled exclusively by Apple with the payment method stored in your Apple Account. I receive no payment data.

One-time purchases (non-consumable)

One-time purchases (for example a competition package in FamilyCup or the full version of LumaLink) are permanently linked to your Apple Account and can be reloaded on your devices with "Restore purchases".

Subscriptions

Subscriptions (for example the RunCoach Assistant, the FamilyCup photo subscription, Freiraum Kids subscription/Plus, Freiraum Life/Family/Family Plus) renew automatically for the respective period (month or year) at the stated price unless you cancel at least 24 hours before the end of the current period. The amount is charged to your Apple Account within 24 hours before the end of the period. You can manage and cancel subscriptions at any time in iOS Settings under your Apple Account › Subscriptions. Cancellation takes effect at the end of the paid period; the service remains available until then.

Trials

Free trials (for example 30 days for Freiraum Life & Family, 7 days for LumaLink, one month for the RunCoach Assistant) apply once per Apple Account. If a subscription is not cancelled before the trial ends, the paid period begins. Any unused part of a trial is forfeited upon purchase.

Price changes

Apple notifies you in good time of price changes for ongoing subscriptions; depending on the amount you must consent, otherwise the subscription ends at the end of the paid period.

5. Right of withdrawal and refunds

For in-app purchases, the consumer right of withdrawal applies under the Apple Media Services terms. For digital content and services supplied immediately with your express consent, the right of withdrawal may expire once performance begins; Apple informs you at the time of purchase. Refund requests are made directly to Apple at reportaproblem.apple.com. I cannot refund or cancel App Store purchases myself.

Some apps offer consumable credits, for example photo packs for the FamilyCup Assistant. The following applies:

You can create content in the apps: display names, group and tournament names, mottos, photos, names of participants, clubs and players, tasks, appointments, documents and similar ("user content"). The following applies:

8. AI features (assistants)

Some apps offer optional AI features, such as the FamilyCup Assistant (reading tournament sheets and entry lists from photos), the RunCoach Assistant (training tips and plans), the AI features of Freiraum Life & Family (photo scans, summaries, suggestions) and the assistant in Freiraum Kids (weekly schedule from age, routine and a timetable photo). The following applies:

9. Health, sport and safety

RunCoach analyses movement and health data and gives training guidance. This guidance does not replace medical examination or advice. Train at your own responsibility, heed your body's warning signs and discuss training loads with a doctor in case of pre-existing conditions, pregnancy or complaints. Metrics such as heart-rate zones or VO₂max are estimates.

Freiraum Life & Family (medicine cabinet) manages information on medicines, expiry dates and deadlines that you enter yourself or capture by photo. The app replaces neither the package leaflet nor medical or pharmaceutical advice; always check recognitions and warnings yourself.

LumaLink uses the camera LED and the screen as a light source. Flashing and strobe functions (signal, SOS, disco mode) can cause discomfort or seizures in light-sensitive people; use them considerately and not in road traffic. The SOS function is a signalling aid and does not replace an emergency call or approved safety equipment. Prolonged use can heat the device and strain the battery; the battery guard is a convenience feature without guarantee.

10. Minors and families

Freiraum Kids is aimed at parents and guardians who set up the app for their children. Setup, rules, time accounts and approvals are the responsibility of the parents or guardians; they ensure that the child's use is age-appropriate and consistent with Apple's Family Sharing rules. The app uses Apple's Screen Time interfaces; their technical limits (for example system changes, uninstallation or circumvention by the child) are beyond my control. Freiraum Kids is a tool for family agreements, not seamless control.

If children use other apps (for example predicting in FamilyCup), this is done under the responsibility of the parents or guardians. In-app purchases can be protected with Family Sharing's "Ask to Buy".

11. Availability, server services, third-party data and changes

Some features require server services (for example live data, push notifications, Live Activities, the FamilyCup web page, AI assistants, photo quotas). I strive for high availability but owe no specific availability; maintenance, outages at third parties (Apple, Cloudflare, Google, data providers) and force majeure may cause restrictions.

Fixtures, results, tables, line-ups and statistics of leagues and competitions come from third-party providers and are displayed without warranty as to accuracy, completeness or timeliness. Prediction scoring uses the results shown in the app; corrections may follow later.

I may develop, change or discontinue features, in particular if third parties change their services, competitions end or continuation becomes unreasonable. Paid services remain available at least for the paid period or are refunded proportionally.

The apps store shared data predominantly in your own Apple iCloud or locally on your devices. Apple's terms apply to backup and availability of that storage; keep backups of your devices.

12. Privacy

What data the apps process is described in the privacy policies: smartIDEA (all apps), FamilyCup, RunCoach. The privacy policies are not part of these terms but inform you about data processing.

13. Intellectual property and trademarks

The apps, their design, texts, graphics, software and server services are protected by copyright and remain my property or that of the respective rights holders. Names such as Bundesliga, Premier League, La Liga, Serie A, Ligue 1, Ekstraklasa, MLS, DFB-Pokal, Champions League, Europa League, Conference League as well as club names and crests are trademarks or signs of their owners. The apps are not licensed, endorsed by or affiliated with these organisations; names and crests are used solely to identify competitions and teams. Apple, iPhone, Apple Watch, iCloud, App Store and Siri are trademarks of Apple Inc.

14. Warranty and liability

For free services I am liable only for intent and gross negligence and for fraudulently concealed defects. For paid services the statutory warranty rights for digital products apply.

I am liable without limitation for damage arising from injury to life, body or health, for intent and gross negligence, under the Product Liability Act and within the scope of a guarantee I have given. For slightly negligent breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded.

In particular, no liability is assumed for consequences of incorrect third-party data, for AI results you adopt unchecked, for data loss that could have been avoided by backups or by changes to your iCloud, or for damage caused by use contrary to these terms or the safety notices in section 9.

15. Term, termination and suspension

The free usage agreement runs for an indefinite period; you end it by deleting the app and, if desired, your data in the app ("Delete my data"). Subscriptions end under section 4.

I may suspend access to server services or remove content if you violate these terms, in particular in case of quota abuse, unlawful content or attacks on the services. Before a permanent suspension I will inform and hear you where possible.

16. Changes to these terms

I may amend these terms where required by new features, changes in law or changes in third-party services, provided the change does not unreasonably disadvantage you. Material changes are announced in the app or on this page with the version date. For ongoing subscriptions, changes affecting the core of the service apply only from the next renewal; you may cancel the subscription until then.

17. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. The contract language is German; translations are for information only.
